The sector is distinct for four reasons. B2B email carve-out plus standard data and advertising rules

PECR Regulation 22 contains a B2B carve-out: unsolicited marketing email and SMS to corporate subscribers (limited companies, LLPs, Scottish partnerships, government bodies) does not require prior consent, though sole traders and most ordinary partnerships are treated as individuals and need consent or a valid soft opt-in. The ICO still requires a clear sender identity and a working opt-out on every message, and UK GDPR continues to apply to any named individual at a business address, which covers most usable B2B data. PECR Regulation 6 (cookies and similar technologies) applies regardless of audience, so B2B websites need the same consent banner discipline as B2C. The Data (Use and Access) Act 2025 raised PECR's maximum fine from £500,000 to £17.5 million or 4% of global turnover. The Advertising Standards Authority enforces the CAP Code on B2B product claims in ads and on websites.
